Toys and Cosmetics (Limit of Chemicals) Regulation 2022

On 16 June 2022, the Toys and Cosmetics (Restricted Chemical Substances) Regulation 2022 (S.I. 2022 No. 659) was published in the United Kingdom, amending the limited substance requirements in the Toys and Cosmetics regulation. These amendments apply to the United Kingdom (England, Wales, and Scotland). Among them, the updated toy regulations mainly include:

 

(1) Allergenic spices, item 10 2-octane methyl ester was deleted from Table 2 in Point 11 of Part 3 in The second schedule. Three prohibited allergenic spices were added in Table 1, increasing the number of prohibited allergenic spices from 55 to 58. This update will take effect on October 15, 2022. The addition of three new allergenic fragrances in the UK is in line with the requirements of the European Union Directive 2020/2089, which will come into force in EU member States and Northern Ireland from 5 July 2022.

 

(2) For the migration of specific elements, modify the migration limits of aluminum in the table at Point 13 of Part 3 in Schedule 2. The aluminum limits will take effect on December 15, 2022. The updated aluminum migration limits in the UK are the same as those required in European Union Directive (EU) 2019/1922. The directive has been implemented in EU member States and Northern Ireland since May 20, 2021.

 

(3) Aniline and formaldehyde, new requirements for aniline and formaldehyde for toys for children under 36 months of age or toys intended to be imported (Appendix C of Schedule 2). The requirement will take effect on December 15, 2022. The UK’s new aniline requirements are the same as those of the European Union Directive (EU) 2020/903, which will apply in the EU Member States and the UK region of Northern Ireland from 5 December 2022. This new formaldehyde requirement is the same as the requirement of the European Union Directive (EU) 2019/1929, which has been implemented in the EU Member States and Northern Ireland of the United Kingdom from 21 May 2021.
